This End User License Agreement ("Agreement") governs your use of the Wake Devils mobile app ("the App"), operated by Wake Devils ("the Club," "we," "us"). By creating an account, you agree to be bound by this Agreement. If you don't agree, don't use the App.
The App is for use by Wake Devils club members and prospective members. You must be at least 13 years old to create an account.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, solely for its intended purpose — participating in the Club's community features and booking boat outings. You may not copy, modify, reverse-engineer, distribute, or create derivative works from the App.
You're responsible for the accuracy of the information you provide and for anything that happens under your account. Don't share your password or let someone else use your account. Tell us right away if you think your account has been accessed without your permission.
The App includes features for club members to communicate with each other — direct messages, group chats, and comments on club announcements. You agree not to use these features to post, send, or share content that:
• Is threatening, harassing, abusive, or intended to bully or intimidate another person; • Is hateful, discriminatory, or targets someone based on a protected characteristic; • Is sexually explicit, obscene, or otherwise inappropriate for a club community space; • Is false, defamatory, or impersonates another person or the Club; • Is spam, a scam, or unrelated commercial solicitation; • Violates any other person's privacy or legal rights, or is otherwise illegal.
This applies to every piece of user-generated content in the App — messages, comments, group names, and reports.
The App automatically screens new messages, comments, and posts for common objectionable language before they're posted. Any member can report a message, comment, post, or another member they believe violates this Agreement, and can block another member to stop seeing their content.
Club admins review reports and may remove content that violates this Agreement, and may suspend or permanently remove a member's access to the App for violations — typically acted on within 24 hours of a report. We may take these actions without prior notice.
You keep ownership of the content you post (messages, comments, profile photo). By posting it, you give the Club a license to store, display, and transmit it within the App as needed to operate the App's features — for example, so a group chat message reaches the other members of that group. This license ends when you delete the content or your account, except for content already visible to other members before that point.
Booking a seat on a club boat outing through the App is subject to the Club's separate Terms & Conditions and Liability Waiver, which you agree to separately when creating an account — that document covers the physical risks and rules of the on-water activity itself, and takes precedence over this Agreement for anything related to boat outings. Payments for paid outings are processed by Stripe; the Club never receives or stores your card details.
You may stop using the App at any time and request deletion of your account from within the App. We may suspend or terminate your access to the App if you violate this Agreement, or if you're no longer eligible for Club membership. Sections of this Agreement that by their nature should survive termination (like ownership, disclaimers, and limitation of liability) will survive.
The App is provided "as is," without warranty of any kind. We don't guarantee the App will be uninterrupted, error-free, or available at all times. This is a club-run app maintained on a volunteer basis, not a commercial product with a service-level guarantee.
To the fullest extent permitted by law, the Club and its officers and volunteers aren't liable for any indirect, incidental, or consequential damages arising from your use of the App. This limitation doesn't apply to the physical risks of boat outings themselves, which are governed by the separate Liability Waiver referenced in Section 8.
We may update this Agreement from time to time. If we make a meaningful change, we'll update the version date at the top. Continuing to use the App after a change means you accept the updated Agreement.
This Agreement is governed by the laws of the State of Arizona, without regard to its conflict-of-law provisions.
