Wake Devils — Terms & Conditions and Liability Waiver

Introduction

Please read this agreement carefully before creating an account. It applies to all Wake Devils ("the Club") activities, including boat outings, wakeboarding, wake surfing, tubing, and any other on-the-water activity organized by the Club. By checking the box below and creating an account, you agree to be bound by its terms.

1. Assumption of Risk

Wakeboarding, wake surfing, tubing, and other boat-towed water sports, along with riding in or operating a boat, are inherently dangerous activities. Even when conducted in accordance with all applicable rules and under supervision, these activities carry an inherent risk of serious injury, permanent disability, or death, as well as damage to property. Risks include, but are not limited to, collision with the boat, the tow rope, other watercraft, or submerged or floating objects; falls; drowning; adverse weather; and equipment failure. By participating in any Club activity, you voluntarily and knowingly assume all risks associated with participation, whether known or unknown, and whether arising from the negligence of others or otherwise.

2. Release of Liability

In consideration of being permitted to participate in Club activities, you, on behalf of yourself and your heirs, executors, administrators, and assigns, release, waive, discharge, and covenant not to sue Wake Devils, its officers, board members, coaches, boat drivers, and volunteers, from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by you, or to any property belonging to you, while participating in Club activities — whether caused by the negligence of the released parties or otherwise — to the fullest extent permitted by applicable law. This release does not excuse liability for gross negligence, recklessness, or intentional misconduct, to the extent such a limitation is required by law.

3. Participant Responsibility

You are responsible for your own safety and conduct during all Club activities. You agree to: follow the instructions of Club officers and boat drivers; wear a properly fitted, U.S. Coast Guard-approved life jacket at all times when on or being towed behind a boat; use all required safety equipment; refrain from participating while under the influence of alcohol or any drug or medication that could impair your ability to participate safely; and remove yourself from an activity — or accept removal by a Club officer or driver — if you are unable to participate safely. The Club may refuse participation to anyone who appears impaired, is not properly equipped, or otherwise poses a safety risk to themselves or others.

4. Medical Fitness & Emergency Treatment

By agreeing to this waiver, you represent that you are physically fit to participate in Club activities, or that you have disclosed any condition that might affect your ability to participate safely to a Club officer beforehand. You consent to receive emergency medical treatment, including transportation to a medical facility, if you are injured or become ill during a Club activity and are unable to give consent at that time, and you understand that you (or your insurance) are responsible for any resulting medical costs.

5. Water Competency

You represent that you know how to swim and are reasonably comfortable and competent in open water. This does not replace the life-jacket requirement above, which applies regardless of swimming ability.

6. Photo & Media Release

The Club may take photographs and video during its activities and events. By participating, you grant the Club permission to use your name, image, and likeness captured during these activities in Club promotional materials, social media, and its website, without compensation. This is optional — if you do not want your image used this way, you may opt out at any time by notifying a Club officer in writing; opting out does not affect your ability to participate.

7. Acknowledgment

You acknowledge that you have read this Terms & Conditions and Liability Waiver in its entirety, that you understand its contents, and that you are agreeing to it voluntarily and of your own free will. This is a legally binding agreement between you and the Club. If any provision of this agreement is found unenforceable, the remaining provisions remain in full force and effect.
